1. Purpose and application

This Download and PDF Disclaimer ("Disclaimer") explains how documents and files made available by Luminera (Pty) Ltd ("Luminera", "we", "us" or "our") should be accessed, interpreted, stored, shared and used.

It applies to files offered through https://lumineraafrica.com, email, QR codes, cloud links, presentations or other authorised channels, including legal notices, company profiles, catalogues, brochures, product summaries, technical references, enquiry summaries and similar downloadable material.

It should be read with the Website Terms of Use, Privacy Notice, Quote Request Terms, Product and Specification Disclaimer, Concept-Image and Supplier-Image Disclaimer and any project-specific quotation, contract, approved schedule or manufacturer document.

Core rule A downloaded document is a controlled copy only as at its stated version or publication date. Users should confirm that they are relying on the latest authorised version and must not treat general public material as a substitute for project-specific written approval.

2. Documents and downloads covered

Company profile and public catalogueGeneral information about Luminera, product families and commercial scope. Publication remains subject to final review, approved visuals and current product positioning.
Product and technical summariesGeneral reference material that may be based on manufacturer information. Project-specific configuration, suitability and performance require written confirmation.
Quotation or enquiry documentsCustomer-specific records governed by their own issue date, revision, validity, assumptions, exclusions and acceptance requirements.
Manufacturer or supplier documentsThird-party material supplied for reference or for an identified product. Ownership, language, version, warranty and technical limitations may remain with the issuing third party.
Internal or restricted filesPrice lists, supplier costs, margins, internal calculations, governance records and other non-public information. These may not be accessed, shared or published without authority.

3. Document status, approval and version control

Each material document should display, where appropriate, its title, issuing entity, version number, compilation or issue date, approval status, classification and review cycle. A file marked "draft", "for review", "pending approval" or similar is not the final effective public document.

  • The current authorised version published by Luminera should be used unless a later project-specific document has been issued directly to the relevant customer.
  • A filename alone is not proof that a file is current or authentic. Users should check the document content, version, date and source link.
  • Saving, printing, forwarding or caching a file does not prevent it from later becoming outdated or withdrawn.
  • Luminera may preserve archived or superseded versions for governance, evidence, legal, contractual or audit purposes, but those versions should not be used as current public guidance.

4. General information and project-specific confirmation

Public downloads are generally provided for information, orientation and preliminary discussion. They do not by themselves constitute a quotation, offer, contract, reservation, technical approval, professional design, engineering advice, installation instruction, warranty undertaking or promise that a product is suitable for a particular site or purpose.

A customer must rely on the latest project-specific quotation, approved product schedule, manufacturer confirmation, sample, drawing, contract and other written documents applicable to that project. Site information, measurements, engineering, approvals and installation remain the responsibility of the customer and its appointed professionals unless Luminera expressly agrees otherwise in writing.

5. Public, restricted and confidential documents

Private / admin-onlyFinal product price list, supplier quotations, supplier identities where confidential, landed-cost calculations, margins, internal notes, lead records, access logs and administration records. Do not publish or expose through the public website.
Private corporate recordsInformation Officer certificate, signed directors' resolutions, governance records, credentials, recovery codes and similar records. Retain securely and share only when lawfully required or authorised.

The accidental availability of a restricted or confidential file does not convert it into a public document or grant permission to use, copy or disclose it. A recipient who reasonably believes a file was disclosed in error should stop using it and notify Luminera.

6. Accuracy, currency and changes

Luminera takes reasonable care when preparing public documents, but products, manufacturers, specifications, availability, commercial scope, legal requirements, service providers, website features and business information may change. Typographical, formatting, conversion or transmission errors may also occur.

Luminera may correct, replace, withdraw or update a document without individually notifying every person who previously downloaded or received it, unless a contract or law requires notice. Users should check the website or contact Luminera before materially relying on an older copy.

Dates, prices, lead times, exchange-related assumptions, freight information and manufacturer details are particularly time-sensitive. Public documents do not override the validity period or conditions of a formal quotation.

7. Manufacturer and third-party documents

Some downloads may contain, reproduce, link to or accompany manufacturer, supplier, standards-body, service-provider or other third-party information. That material may be subject to separate copyright, licence, disclaimer, confidentiality, language, revision and warranty conditions.

Luminera may summarise or transmit third-party information for legitimate product-selection and supply purposes, but does not become the author or guarantor of every third-party statement. A manufacturer document should be checked against the exact model, configuration, batch, region, issue date and project requirements.

Third-party names, marks, logos and documents remain the property of their respective owners. Their inclusion does not imply an endorsement or partnership beyond the relationship accurately described by Luminera.

8. Specifications, quotations and document priority

Where documents differ, the more specific and later authorised project document will ordinarily take priority for that project, subject to applicable law and the express terms of the documents. The following practical order should be used unless a signed agreement states otherwise:

5Older, archived, cached, printed or third-party copies of public documents.

This priority guide does not replace the interpretation provisions of a signed agreement and does not permit a person to disregard mandatory legal rights or obligations.

9. Download integrity, security and file risks

Luminera intends to provide downloads through reasonable technical and security controls. However, no electronic transmission, storage medium, website or file format can be guaranteed to be continuously available, error-free or free from every malicious, corrupted or incompatible element.

  • Use current security software and an updated PDF or document reader.
  • Download files only from an authorised Luminera website, mailbox or link and check unexpected requests or altered domains carefully.
  • Do not enable macros, scripts or active content in an unexpected file. Ordinary public Luminera PDFs should not require macros.
  • Contact Luminera before opening or using a file that appears damaged, altered, password-protected unexpectedly, unsigned where a signature is required, or inconsistent with the website version.
  • Luminera does not ask customers to disclose passwords, recovery codes or banking credentials through a public downloadable form.

A user remains responsible for maintaining suitable device, network, backup and access controls. If a security compromise or fraudulent file is suspected, notify Luminera promptly and do not forward the file further.

10. Intellectual property and permitted use

Unless otherwise stated, Luminera documents, original text, layout, branding and compilations are owned by or licensed to Luminera. Third-party material remains subject to the rights of its owner or licensor.

An authorised public document may be downloaded, printed and shared in its complete, unaltered form for legitimate personal, customer, professional, evaluation or procurement purposes. This permission does not transfer ownership and does not authorise commercial resale, competing publication, data harvesting, removal of notices or use that misrepresents the source or relationship.

Project-specific, customer-specific, confidential, restricted or licensed third-party documents may be used only for their authorised purpose and subject to applicable agreement, confidentiality and licence restrictions.

11. Prohibited alteration, republication and misrepresentation

A person may not alter, extract, combine, relabel or republish a Luminera document in a way that creates a false or misleading impression. In particular, a person must not:

  • remove or change the Luminera name, date, version, classification, disclaimer, image label, copyright notice or approval status;
  • present an edited extract as the complete document or as a current Luminera statement;
  • add prices, specifications, warranties, approvals, signatures, customer names or project claims that Luminera did not authorise;
  • publish the private price list, supplier costs, margins, internal calculations or confidential manufacturer material;
  • use a concept rendering or supplier reference as evidence of a completed Luminera installation; or
  • use Luminera branding or documents to imply agency, dealership, endorsement, partnership or authority that has not been granted in writing.

Reasonable quotations or excerpts may be used where legally permitted, provided the context is accurate, the source and version are identified, and the use does not infringe rights or disclose confidential information.

12. Accessibility and alternative formats

Luminera aims to provide readable public documents and may offer accessible or alternative formats where reasonably practicable. Document appearance can vary between devices, browsers, printers and PDF readers, and some tables, links, signatures or visual elements may not display identically.

A person who cannot reasonably access a public document may contact Luminera to request assistance or an alternative format. Luminera may need to verify identity or authority before providing customer-specific, confidential or legally restricted information.

13. External links, QR codes and embedded content

A document may include a link, QR code or reference to a third-party website, cloud service, manufacturer page, video, standard, form or resource. That external content may change or become unavailable after the document is issued and is governed by the third party's own terms, privacy practices and security controls.

Users should verify the destination before following a link or scanning a QR code. Luminera is not responsible for an unauthorised person replacing, redirecting or misusing a code or link after a document has left Luminera's control, although Luminera will take reasonable corrective steps when notified of a genuine concern.

14. Corrections, withdrawal and superseded documents

A person may notify Luminera if a document appears inaccurate, inaccessible, damaged, altered, misleading, outdated or disclosed without authority. The notice should identify the document, version, source and concern and include supporting information where available.

Luminera may investigate, correct, replace, withdraw, restrict or reissue the document; notify affected recipients where reasonably necessary; preserve an evidential copy; and update links, source records or website notices. A withdrawn document should not continue to be represented as current.

Version check Before relying on a saved or forwarded copy, compare its title, version and date with the authorised version on the Luminera website or contact [email protected].

15. Reliance, liability and rights preserved

Users should exercise reasonable care and obtain project-specific confirmation or professional advice where the matter involves design, engineering, compliance, safety, installation, procurement, material cost or another significant decision.

To the maximum extent permitted by law, Luminera is not responsible for loss caused solely by reliance on an obviously outdated, altered, incomplete, unauthorised or clearly general document where the user failed to obtain current project-specific confirmation. Luminera is also not responsible for third-party alteration or redistribution outside its reasonable control.

Nothing in this Disclaimer excludes, limits or waives any right, remedy, duty or liability that cannot lawfully be excluded, including applicable consumer rights, rights relating to accurate representations, privacy, confidentiality, intellectual property and electronic communications. If a provision is invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law.

17. Approval and version control record

This Disclaimer is issued on behalf of Luminera (Pty) Ltd after approval by the founders. It should be reviewed at least annually and whenever Luminera changes its public downloads, catalogue or profile, document classifications, website file controls, security practices, third-party document use or applicable requirements.
